Welcome to www.fudl.co.uk website and our mobile applications. Before placing any order through our website or mobile applications please read the following terms and conditions carefully, which explains your obligations and legal rights. By accessing our site and placing an order you agree to be bound by the terms and conditions and our privacy policy. Our Terms and Conditions change from time to time and we advise you read these when you visit our website.

1. OUR SERVICE
www.fudl.co.uk website and the FUDL mobile applications are operated by PERITOM Limited ("we" or "us" or "FUDL"), incorporated and registered in the England and Wales. Our company registration number is 08682154 and our VAT number is 176142705. FUDL is an online platform that connects caterers who cook food in home style for the customers seeking to buy such food (the "Meals") and in cases where the caterer doesn't have a delivery service we deliver the Meals (collectively, the “Services”), which Services are accessible at http://www.fudl.co.uk and applications for mobile devices through which FUDL makes the Services available (collectively, the “Application”). The purpose of our Service is to provide a simple and convenient Application linking you to the caterers and allowing you to order Meals from them. FUDL acts as an agency between you and the caterers, concludes orders on behalf of the caterers and delivers the Meals to you.

2. APPLICATION ACCESS
Our Application and Services can be used by anyone who is 18 years or above. By accessing our Application or Services you warrant that you are at least 18 years old and legally capable of entering into binding contract. You may access our Application and Services as a guest, without registering your details with us. We may restrict access to some parts our Application to users who have registered with us. We reserve the right to withdraw or amend your access to our Application or our Service. You agree that your access to our Application and Services are for lawful purposes only and you agree not to damage or disrupt any part of our Application or our Service. You also agree to keep your username and password confidential and not to share it with anyone else. If you have any concerns about misuse of your login details then you should contact our customer support team immediately.

3. PLACING ORDER
After selecting your Meal for your intended delivery date and time and provided the other required information, you can submit your Order by clicking or selecting the "Continue", "Checkout", "Confirm Order" or similar button. Before placing the order you must ensure that all the information that you have entered are correct; once you do so your order will be processed and errors may not be corrected. You may cancel or amend your order, through our Application or by contacting our Customer Services team, before the caterer starts preparation for your Meal. Any cancellation after caterer prepares for your Meal will attact a cancellation charge. On receipt of your Meal Order or Cancellation or Amendment request, we will begin processing it by sending it to the relevant caterer and will notify the confirmation of your order by email or SMS. If your provided payment details can not be autorised then your order will not be sent to the caterer.

Please note that the caterer for your selected Meal may not accept your order or may cancel your order at any time due to weather conditions, traffic disruptions or any other reason that are not in their control. In such cases we will notify you by email or SMS immediately.

The estimated delivery or collection time are for indicative purposes only and doesn't guarantee that your Meal will be delivered or ready for collection with in the estimated time.

4. PRICE & PAYMENT
Prices quoted on our Application are inclusive of VAT but may exclude delivery and payment administration charges. If any delivery charge or payment administration charge is applicable for your selected delivery option or the payment method then these will be added to the total amount. In case your ordered Meal has been incorrectly priced then we will notify you as soon as we can about the pricing issue and you will have the option to cancel your order or amend your order. Your payment is made directly to FUDL and is subsequently passed on by FUDL to the relevant caterer. 

5. VISITOR INFORMATION AND REVIEWS
Any reviews that you post or any non-personally identifiable information that you upload through our Application ("Visitor Information") will be considered non-confidential and non-proprietary. Personally Identifiable information posted or transmitted by you are covered under Privary Policy. By posting, uploading or transmitting any Visitor Information, you represent and warrant that you are the owner or you have the rights to such Visitor Information. You agree that we will free to use any of the Visitor Information posted by you for any and all commercial or non-commercial purposes. The reviews that you submit through the Application must not be violate any local, national and international laws. We have the right to administer and verify the genuineness of your feedback and we have the right to publish or remove your reviews from our Application. The Reviews posted by others are for information purposes only and reflect the opinions of customers; we do not take any responsility or liability for any Reviews posted by Vistors. 

6. RESPONSIBILITY & LIABILITY
Our catering partners prepare different Meals in their kitcken, which may handle nuts, meat, sea food and other allergic ingredients. So we cannot guarantee that any of Meals are free from cross-contamination of allergens. It is your responsibility to read the caterer's published allergy advise and decide whether the Meal is suitable for your taste and allergy tolerance. If you have any questions on ingredients or allergic content of a Meal, we advise you to contact our customer services team.

Although we take all care in ensuring that all information provided in our Application is accurate and up-to-date but we do not promise that all information is complete and accurate. We will not be responsible for any errors or incompleteness of any such content in our Application or for any technical problems that you may encounter with our Application. If any imcompleteness or any error in our Application or Service are reported us then we will take all care to it as soon as possible.

We exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our Application or our Services. This does not affect our liability which cannot be excluded or limited under applicable law.

You acknowledge and agree that we will fully co-operate with any competent authority requesting or directing us to disclose the identity or location of anyone using our Application or Services. 

The images published on our website are meant to give an impression of what the meal contains but in no way it represents the actual meal or how it is packaged.

7. COMPLAINTS

Although FUDL is not responsible for the Meals prepared by the caterers but to ensure a quality service from all our partner caterers we encourage our customers to provide feedback and reviews on the Meals. If any of the listed Meals on our application consistently receives below average review (review has to be from genuine customers who have ordered the Meals) then will take necessary steps to remove the Meal from our listing. If all the lsited Meals from a caterer consistently receives below average review then we will take necessary steps to terminate our service agreement with the caterer. Reviews and feedback provided by you are important part of our quality control process.

Satisfaction of our customers is extremely important to us. If you are dissatisfied with quality of the Meals by the caterer and wish to seek refund or replacement you should contact our customer services team immediately. As the Meals prepared by our partner caterer are meant for consumption with in 45 minutes from the delivery, we advise you to consume it fresh. The prepared Meal is expected to stay fresh for up to 4 hours depending on the weather and surrounding. For any complaints about the delivered Meals we advise you to contact our customer service with in 2 hours.

8. PROMOTIONAL OFFERS
We may run promotional offers from time to time to pass on special discounts or loyalty reward points to our customers. We reserve the right to introduce new promotional offers and discontinue any promotional offers. All our promotional offers are subject to terms and conditions.

Terms and Conditions for Current Promotional Offers
FUDL25 : (1) Customer must be a registered and logged into their account to use the coupon code (2) The coupon code can be used only once by a customer (3) Only the first 25 orders using the coupon code will get 10% discount on their total order value.
FUDL100 : (1) Customer must be a registered and logged into their account to use the coupon code (2) The coupon code can be used only once by a customer (3) Only the first 100 orders using the coupon code will get 10% discount when the order value is more than £15.
Buy One Get Next Meal FREE: (1) Place your order before 5th Dec 2014 (2) Leave your feedback for the meal (3) Refer our services to one of your friends (4) When your friend registers, claim your FREE meal and a meal credit will be added to your FUDL account (5) Offer open to all registered customers (6) Offer valid for each paid meal that you buy before 5th Dec 2014 (7) FREE meal can be of same value as that of the paid meal or £7.00, whichever is lower.

9. GOVERNING LAW & JURISDICTION
Terms & Conditions as mentioned on this page shall be governed by and construed in accordance with the laws of England and any disputes or claims arising in connection with our Application or Services shall be subject to the jurisdiction of the English courts.
